Employers have certain obligations they must uphold when handling the dismissal of an employee. When they fail to do so they expose themselves to liability for damages incurred as a result of bad faith termination.

What Is "Bad Faith?"
Recent case law has stated that, "in the course of dismissal, the employers ought to be candid, reasonable, honest and forthright with their employees, and should refrain from engaging in conduct that is unfair or is in bad faith by being, for example, untruthful, misleading or unduly insensitive."
What does that mean for your case? If your employer has breached its duty of good faith, you may be entitled to additional damages known as "moral damages" by the courts. An assessment of whether an employer has breached its obligation of good faith dealing to an employee and what damages, if any, could result in that breach should be assessed by a competent legal professional who specializes in this area of the law.
